End User License Agreement

14. Applicable Law. This Agreement is governed by the laws of
the State of Minnesota, exclusive of its choice of law rules.
15. Severability. If any part of this Agreement is held to be
illegal, unenforceable or in conflict with applicable law by a
court of competent jurisdiction, the validity of the remaining
portions of this Agreement, and all rights and obligations
shall be construed and enforced as if this Agreement did not
contain the particular part held invalid.
16. Third Party Beneficiaries. Wind River and its licensors are
third party beneficiaries of this Agreement and the provisions
relating to the Module are made expressly for the benefit of,
and are enforceable by, Wind River and its licensors.
17. Entire Agreement. This Agreement is the entire agreement
between You and Medtronic relating to the Module and the
support services (if any) and it supersedes all prior or
contemporaneous oral or written communications, proposals
and representations with respect to the Module or any other
subject matter covered by this Agreement. No person has
authority to bind Medtronic or Wind River to any
representation, condition or warranty contrary or in addition
to the terms of this Agreement, except as set forth in any
written warranty supplied by Medtronic for the Generator.
