War ranty
The MALIS CMC-III Bipolar Electrosurgical System is warranted for two full
years from date of purchase. The MALIS CMC-III System is warranted to be
free from defects in both mate rials and workmanship. This war ranty shall
not apply where service is required due to (i) Buyer's failure to operate or
maintain the equip ment according to the Instruc tion Manual, (ii) Buyer's use
of unau thor ized parts or consumables, (iii) acci dent, abuse, misuse, modifica-
tion or mis ap pli ca tion, or (iv) improper service. THE ABOVE WARRAN-
TIES ARE IN LIEU OF ALL OTHER WAR RAN TIES, EITHER EXPRESS
OR IMPLIED, INCLUDING ANY WAR RANTY OF MERCHANTABILITY
OR FITNESS FOR A PAR TIC ULAR PURPOSE. Suitability for use of the
device for any surgical pro ce dure shall be determined by the user. Neither
Codman & Shurtleff nor its affiliated companies shall be liable for incidental
or consequential damages of any kind.
