costs of disassembly and reassembly
will be at the expense of the owner.
4.2. Contrary to the provisions of the
previous subclause, in the event of
construction and/or material defects in
frames and front forks, the labour costs
are also at the expense of the manu-
facturer for 3 years from the purchase
date of the bicycle.
4.3. Costs of transport of the bicy-
cle and/or components from and to
Batavus B.V. will be at the expense of
the owner, unless the component in
question is eligible for guarantee.
4.4 If a specifi c component is eligible
for guarantee and the original is no
longer available, Batavus B.V. will pro-
vide an alternative which is at least the
equivalent of the original component.
CLAUSE 5 SUBMITTING A CLAIM
5.1. Claims under this guarantee must
be submitted for inspection via the
Batavus dealer from whom the bicycle
was bought, along with the bicycle or
component in question. At the same
time the sales receipt must be submit-
ted to the dealer along with the Certi-
fi cate of Ownership received when the
bicycle was purchased.
5.2. If the owner has moved house or
the dealer is no longer available, Ba-
tavus B.V. will, if required, inform the
client of the nearest Batavus dealer.
CLAUSE 6 LIABILITY
6.1 A guarantee claim honoured by
Batavus B.V. does not automatically
mean that Batavus B.V. will also accept
liability for any damage sustained.
Batavus B.V.'s liability will never exceed
that which is described in these guaran-
tee conditions. Batavus B.V. explicitly
excludes any liability for consequential
damage. The stipulations of this condi-
tion do not apply if and to the extent
that such liability arises from a manda-
tory statutory provision.
