The manufacturer considers the failure to report any kind of error, omission, typographical error, inconsistency et
cetera of this manual, in relation to instructions and technical information, negligence: the design engineer,
installer and user (maintenance engineers) must promptly report situations which could lead to a reduction in the
safety of persons, property and the environment to the manufacturer, acting with the required skill,
professionalism, cooperative spirit and diligence.

Any negligent or careless behaviour, indicating poor technical/professional skill exempts the
manufacturer from any possible consequence and responsibility.

2.3.2 - Responsibilities of the design engineer and installer

The installer and/or the design engineer are obliged to assess risks, provide facilities and emergency, alarm,
signalling and protection systems, and must also provide the overall instructions for the refrigeration plant/system
which the unit is part of as required by Standard EN 378-4.
It is also the task of the design engineer and/or installer to determine the best and safest means and methods to
handle and possibly store the unit outside the manufacturer's premises and/or warehouses. In particular, it is the
responsibility of the design engineer and/or installer to verify the requirements provided by the manufacturer and
make sure they are enforced in the early stages of handling, transport and storage.

The incorrect assessment of risks by the design engineer and/or installer i.e. an inadequate
selection of means and emergency, alarm, signalling and protection systems exempt the
manufacturer from any possible consequence and responsibility.
The design engineer is the person who is involved in the project engineering stage of the refrigeration plant/system
in which the unit is installed and is responsible for both the performance aspect and for the safety aspect. It is
the design engineer's responsibility to choose the most suitable components for the plant that he/she is planning,
within the limits of use that the manufacturer requires for its products. The preparation of the design engineer
and his/her skills must be sufficient to clearly understand the contents of this use and maintenance manual and
any other technical/commercial document relating to the unit, and must also be sufficient to ask the
manufacturer for any clarifications with a view to achieve a functional, safe and up to standard plant/system. In
particular, the design engineer must be able to identify the reasonably foreseeable unit operating conditions
(environmental, installation, loads and stresses, the connection to the electrical, fluidic, hydraulic systems, etc.)
and check that the unit is suitable for such conditions.

Incorrect identification of the unit operating conditions by the design engineer exempts the
manufacturer from any possible consequence and responsibility.
If the project is divided into several parts, the project engineering coordinator, whoever he/she may be, will be
considered a design engineer.
The installer is the person who is involved in the installation and implementation of the system, in compliance
with the project indications, with the component specifications as defined by their manufacturers and with the
highest professional standards. The preparation and skills of the installer must be sufficient to clearly understand
the contents of this use and maintenance manual and any other technical-commercial document relating to the
unit, and must also be sufficient to ask the manufacturer for any clarifications with a view to achieve a functional,
safe and up to standard plant/system.

The staff involved in the various unit installation and commissioning stages must be skilled and
trained. The levels of competence of personnel are specified in Standard EN 13313
If installation is divided into several parts, the installation coordinator, whoever he/she may be, will be considered
an installer.
