or modification of the equipment, use contrary to its designated use, or abnormal operational
conditions.
All guarantee shall expire if equipment repairs or modifications are carried out by persons
other than those authorised by BENDER. The present guarantee conditions are valid exclu-
sively and in place of other contractual or statutory guarantee obligations, including, but not
limited to, the statutory guarantee of marketability, working order, and relevancy for a par-
ticular purpose. BENDER assumes no liability for direct or indirect accompanying or conse-
quential damages, regardless of whether they are attributable to lawful, unlawful or other
actions.
