WARRANTY LAW
Congratulations on your decision to purchase a bicycle from AsVIVA.
According to the European warranty law, which was changed on 01 January 2002,
you are entitled to a legal warranty period of 2 years.
The warranty period begins with the handover of the device by the dealer.
To prove the date of purchase or handover, please keep the purchase documents such as invoice and
receipt for the duration of the warranty period.
In addition to the basic 2-year warranty period, there is a statutory so-called reversal of the burden of
proof for a period of 6 months after delivery of the product. This means that in the event of a defect oc-
curring, it is incumbent on the seller to prove that the defect was not present at the time of delivery and
was not caused by improper use, functional use, functional wear and tear or misuse.
1. The warranty does not apply to:
•
all parts of the bicycle that are subject to function-related wear and tear, when these are not pro-
duction or material defects,
•
damage caused by improper or inadequate care and repairs, conversions or replacements that
have not been repairs, conversions or replacement of parts that have not been carried out professi-
onally,
•
damage caused by improper use and force majeure.
2. Justified warranty claims exist if:
•
the claimed damage or defect at the time of delivery to the customer was already present,
•
no natural or function-related wear and tear was the cause of the wear and tear or change
of the goods (see list of wearing parts!),
•
the damage or defect was not caused by the bicycle not being used as intended.
