TERmS of GuARAnTEE
DIRECTTECH GloBAl® GmBH
I. Scope of the guarantee
DIRECTTECH Global® GmbH (in the following „DIRECTTECH") hereby
grants a guarantee of five years from the date of the purchase of a
DIRECTTECH heating panel by an end customer from DIRECTTECH
directly or through a distributor authorized by DIRECTTECH („Distri-
butor") subject to these Terms of Guarantee. The guarantee is inde-
pendent from claims by the customer against its seller; in particular
warranty claims against the seller remain unaffected.
The guarantee is granted for the infrared radiation systems of the
product line "DIRECTTECH" and the component parts contained
therein. Not covered by the guarantee are wear and tear parts
(particularly limiter, as control device) within the product, expen-
dable materials, brackets as well as separate control devices. The
guarantee solely covers the repair or replacement of such parts of the
DIRECTTECH heating panel which are defective because of defects of
material or defects of manufacturing. DIRECTTECH decides at its own
discretion whether the product shall undergo a repair in order to
restore its functionality or if it shall be replaced in the event of
absolute impossibility restoring its functionality. The repair or repla-
cement do not prolong the term of the guarantee. Replaced parts
remain with DIRECTTECH after the repair and will become property
of DIRECTTECH.
II. place of performance of the guarantee
The performance of the guarantee takes place at the place of
business of DIRECTTECH Global® GmbH at Bullermannshof 21, 47441
Moers, Germany, after the remittance or handover of the defective
product in original packaging. Should a customer, in the case of a
replacement, fail to return the defective product, it will be charged
the price of the replacement product at the then current or last list
price. The guarantee is performed by DIRECTTECH directly and solely
without interposing any third-parties. The costs of remittance/ trans-
port are borne by each party respectively.
III. Exemption from guarantee
The customer grants the time necessary and opportunity to reme-
dy the defect. In practical terms this means that the customer is
obliged to notify DIRECTTECH in writing of the defect (i. e. via letter,
E-Mail) and furthermore to return the faulty product within 14 days
of knowledge of the defect. , DIRECTTECH is exempted from its duties
under these Terms of Guarantee if the customer refuses this form
cooperation. .
Iv. Special exemptions from the guarantee
The following cases are exempted from the guarantee:
• Defects which are caused by the non-observance of the product
manual including the general instructions for use, security advice
and the instructions for installation; in particular e.g. defects
caused by contamination of the product due to failure of regular
cleaning, defects caused by connection to the incorrect line
voltage, as well as defects caused by local conditions such as
excessive dust formation, humidity, gases and vapors etc.;
• Defects caused by unauthorized interference;
• Products, which were incorrectly handled and/ or used and/ or
subject to unauthorized modification;
