11. The entitlement to the warranty shall become void if:
a) the product was not used and maintained in accor-
dance with the user's manual;
b) any construction modifications were carried out on
the equipment without prior authorization issued
by Madal Bal a.s. or an authorized service centre of
the HERON® brand;
c) the product has been used in conditions different
to or for purposes other than those for which it is
intended;
d) a part of the product was replaced with non-origi-
nal components;
e) product damage or excessive wear was caused by
inadequate maintenance;
f) The product was subjected to an accident or
damaged by force majeure;
g) damage was caused by external mechanical, ther-
mal or chemical effects;
h) faults were caused by improper storage, maintenan-
ce (poor quality fuel, failure to clean the fuel system
– decarbonisation, replacement of spark plugs, air
filter), or handling of the product;
i) the product was used in aggressive environments
such as dusty or humid atmospheres;
j) the product was used in excess of the permissible load;
k) any falsification of the warranty card or the proof of
purchase was performed;
l) the actual number of operating hours, operating
conditions and the actual technical condition of the
machine were concealed;
m) unauthorised modifications to the machine's electri-
cal system were performed;
n) seals on the main panel of the machine and carbu-
rettor that may only be handled by an authorised
service centre of the HERON® brand are broken.
12. The warranty does not cover the costs of any tuning
and adjustment works connected with standard work-
shop maintenance of the machines or any service
items such as:
a) standard consumable materials necessary for pro-
blem-free operation such as, for example oils, air
filter, ignition spark plug, connecting materials, etc.;
b) leaking carburettor, clogging of the carburettor, clo-
gging of the fuel system caused by the use of dirty,
contaminated or stale fuel.
13. The extended warranty period does not apply to batteries.
14. The manufacturer takes no responsibility for defects
resulting from normal wear and tear or for use of the
product for purposes other than those for which it is
intended.
15. The warranty does not cover wear and tear on the pro-
duct, which is the natural result of its normal use.

16. It is not possible to claim a free repair on a defect of
a part which has already been provided by a vendor
at a discount. If the consumer attempts to repair the
product themselves, the manufacturer or vendor is not
liable for any damage to the product or personal inju-
ry due to improper repairs or the use of non-original
spare parts.
17. A new 2-year warranty does not apply to replaced pro-
ducts or their parts under warranty from the time of
their replacement, rather the 2-year warranty is calcula-
ted from the purchase date of the entire initial product.
18. The provision of the warranty does not affect the
rights of the buyer, which relate to the purchase of
a product according to special legal regulations.
19. In the event of a dispute between the buyer and the
vendor in respect to the purchase contract that was
not resolved directly between the parties, the buyer
has the right to the trade inspection authority for an
out-of-court settlement of the a consumer dispute. At
the website of the trade inspection authority there is
a link to the tab "ADR-amicable dispute resolution".
ATTENTION!
The distributor - vendor shall not acknowledge the exten-
ded 3-year warranty without specific conditions being met
and without this part of the Warranty and service being
presented with the periodic inspections performed by the
authorized service of the HERON® brand being entered.
