After repair or replacement, your Xbox 360
S or Accessory will remain covered by this
Manufacturer's Guarantee for the longer of
either the remainder of this Manufacturer's
Guarantee Period or a term of ninety five
(95) days after shipment of your repaired
or replaced Xbox 360 S or Accessory by
Microsoft
to you.
UNLESS OTHERWISE PROVIDED UNDER
APPLICABLE LOCAL LAW, MICROSOFT'S
RESPONSIBILITY TO REPAIR OR REPLACE
YOUR XBOX 360 S OR ACCESSORY OR
TO REFUND YOU WITH ITS PURCHASE
PRICE IS YOUR EXCLUSIVE REMEDY
UNDER THIS MANUFACTURER'S
GUARANTEE.

UNLESS OTHERWISE PROVIDED UNDER
APPLICABLE LOCAL LAW, MICROSOFT IS
NOT RESPONSIBLE UNDER THIS
MANUFACTURER'S GUARANTEE FOR
ANY INDIRECT, INCIDENTAL, SPECIAL, OR
CONSEQUENTIAL DAMAGES; ANY LOSS
OF DATA, PRIVACY, CONFIDENTIALITY,
OR PROFITS; OR ANY INABILITY TO USE
YOUR XBOX 360 S OR ACCESSORY.
THESE EXCLUSIONS APPLY EVEN IF
MICROSOFT HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES, AND
EVEN IF ANY REMEDY FAILS OF ITS
ESSENTIAL PURPOSE.
The purpose of this Manufacturer's
Guarantee is to grant you specific
contractual rights. You may benefit from
additional rights under statutory
guarantees owed to you by retailers

and/or manufacturers under any
provision of law applicable to you. This
Manufacturer's Guarantee does not
affect such rights.
5. end user license
You expressly acknowledge that the
software contained in your Xbox 360 S or
Accessory is licensed, not sold, to you.
Such license entitles you to use the
software contained in your Xbox 360 S
or Accessory exclusively in connection
with your use of your Xbox 360 S or
Accessory under normal conditions of
use as defined in Section 1.5 of this
Manufacturer's Guarantee.
Unless otherwise provided under
applicable local law, you may in no event
use the software contained in your
Xbox 360 S or Accessory for other
purposes, and notably you may not:
• remove any component of such
software for use with a device other
than your Xbox 360 S or Accessory;
• sell, rent, lease, lend, distribute,
sublicense or otherwise assign
any or all of your rights to such
software; or
• modify, reverse engineer, decompile
or disassemble such software, for
any reason or purpose whatsoever;
nor ask, help or authorize any third
party to do so.
6. Governing law
This Manufacturer's Guarantee will be
subject to and construed in accordance
with the law of your country of residence,
regardless of conflict of law principles.
