regulations apply. Accordingly, AXSOL disclaims any liability in connection with,
or arising out of, any such use of the Product. You, the purchaser, assume all
risks arising from such or similar use of the product.
AXSOL's warranty does not cover any costs and expenses related to product
overhaul / assembly. AXSOL's warranty also does not cover products that are,
for example, sent in improper packaging, altered or physically damaged.
Products are inspected upon receipt. You can see below an excerpted list of
examples of warranty exclusions:
- improperly packaged or shipped, including the use of improper
shipping containers;
- Any alterations, modifications or physical damage to the Product,
including, but not limited to, deep scratches;
- Alterations, modifications or removal of any labels or barcodes on the
product;
- Opening of the Product enclosure;
- Tampered with or removed serial number
D. Warranty limitations and liability restrictions
EXCEPT FOR THE WARRANTIES SET FORTH HEREIN, AXSOL DISCLAIMS ALL
OTHER WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO
IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE,
MERCHANTABILITY, NON-INFRINGEMENT, COURSE OF DEALING AND USAGE
OF TRADE. ALL EXPRESS AND IMPLIED WARRANTIES ARE LIMITED IN DURATION
TO THE LIMITED WARRANTY.

breach of this agreement. IN NO EVENT SHALL AXSOL, ITS SUPPLIERS OR THEIR
AFFILIATES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL OR
SPECIAL DAMAGES, ANY FINANCIAL LOSS OR LOSS OF DATA OR FILES, EVEN IF
AXSOL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO
EVENT WILL AXSOL BE LIABLE FOR AN AMOUNT GREATER THAN THE AMOUNT
OF YOUR PURCHASE OF THIS PRODUCT. THESE LIMITATIONS AND EXCLUSIONS
APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
E. Law and jurisdiction
This Agreement is made within and shall be construed in accordance with the
applicable laws of the Federal Republic of Germany (except for conflicts of law
provisions that require the application of the laws of another jurisdiction). All
disputes, controversies or claims between the parties arising out of or in
connection with this Agreement (including its existence, validity or termination)
shall be brought in the courts of Würzburg, Germany and shall be conducted in
the German language.
