(8) National technical approval is granted without prejudice to inspection or approval
provisos from other areas of law.
(9) This national technical approval cancels the requirement for suitability determination
pursuant to § 63 of the German Water Management Act (WHG)
However, the user shall be responsible for checking whether the system as a whole requires
a suitability assessment in accordance with the German Act on Installations Handling
Materials Hazardous to Water, even though this is not required for the object of approval
itself.
(10) The period of validity of this national technical approval (see page 1) is in relation to use
within the meaning of installation or set-up of the approved object, and not to later usage.
2
Provisions for constructed products
2.1
General
The containment units and their parts must conform to the Special Provisions and annexes
of this notification, as well as the information filed with the DIBt.
2.2
Properties and composition
2.2.1
Materials
Only the materials named in Annex 2 must be used to manufacture the injection moulded
body of the containment units and the perforated plates (grating) as well as the connecting
parts.
2.2.2
Design details
The design details must conform to Annexes 1 and 1.1 to 1.10. The minimum wall
thicknesses and the minimum weights of the containment units as well as the dimensions
and minimum weights of the deck surfaces (perforated plates) are listed in Annex 4,
Section 1.
2.2.3
Certification of structural stability
The containment units are stable up to an operational temperature of 30°C (40°C for short
periods) when used for the application specified in Section 1.
2.2.4
Reaction to fire
Polyethylene (PE) material, in the thicknesses occurring in the application, has normal
combustibility (class B2 under DIN 4102-1
2.2.5
Operating safety
Any change in the detailed engineering and materials requires amendment of this national
technical approval.
2.2.6
Containment units, perforated plates and connecting parts
The materials of the containment units, perforated plates and connecting parts must comply
with Section 2.2.1 and their design details with Section 2.2.2.
2.3
Manufacture, Packaging, Transport, Storage and Marking
2.3.1
Manufacture
(1) Manufacture must be according to the manufacturing description filed with German
Institute for Structural Engineering (DIBt).
(2) The requirements of Annex 3, Section 1 must be observed in addition to those in the
process description.

(3) The containment units, the perforated plates and the connecting parts may only be

manufactured in the factory 5
of Cemo GmbH.
2.3.2
Packaging, transport and storage
Packaging, transport and storage must be in accordance with Annex 3, Section 2.
2.3.3
Identification
(1) The containment units must be marked by the manufacturer with the conformity mark
pursuant to the conformity mark regulations of the German states. The mark may only be
placed if the requirements in Section 2.4 (certificate of conformity) have been met.
(2) Moreover, the manufacturer of the containment units must mark them clearly and
permanently with the following details:

Manufacturing number;
-
Year of manufacture;
-
Type;
-
Containment volume (as per Section 1 (2), Table 1);
-
Material (HDPE);
-
Deck surface (perforated plate)/containment unit load capacity (as per Section 1, Table 1);
-
"For the storage of substances in accordance with National Technical Approval No. Z-
40.22-549".
2.4
Certificate of conformity
2.4.1
General
(1) Each manufacturing facility must confirm that the containment unit conforms to the
provisions of this national technical approval, with a manufacturer's conformity declaration
based on in-house production controls and an initial inspection (see Annex 4, Section 2) of
the containment units by an appropriately approved inspection agency. The manufacturer
must declare the conformity of the constructed products by marking them with the conformity
mark specifying their intended purpose.
(2) Certification that the PE moulding compound conforms to the provisions of this national
technical approval must be carried out for the manufacturing site by means of a certificate of
conformity based on in-house production monitoring, as well as external monitoring on a
regular basis, including an initial inspection of the moulding compound pursuant to the
following provisions.
(3) To obtain the certificate of conformity and the external monitoring, as well as the
associated product inspections for the PE moulding compound, the applicant must make
arrangements with a certification agency approved for this purpose, as well as a monitoring

approved for this purpose.
(4) A copy of the certificate of conformity granted by the certification agency shall be
submitted DIBt.
(5) The manufacturer must also give a copy of the initial inspection report to the DIBt.

2.4.2
In-house production monitoring
(1) In-house production monitoring shall be set up and performed at the production plant. In-
house production monitoring means the continuous monitoring of production by the
manufacturer with the aim of ensuring that the containment units produced by the
manufacturer conform to the provisions of this national technical approval.
(2) The in-house production monitoring must include at least the measures listed in Annex 4,
Section 1.
(3) The results of in-house production monitoring shall be recorded and evaluated. These
records shall contain the following data, as a minimum:
- For the containment units

Designation of the constructed product and/or source material

Type of monitoring or inspection
-
Date of manufacture and inspection of the constructed product and/or source material
-
Result of monitoring and inspections and comparison with requirements
-
Signature of the person in charge of in-house production monitoring
- For the moulding compound
-
Designation of source material and constituents
-
Type of monitoring or inspection
-
Date of manufacture and inspection of the moulding compound and/or source material
or its constituents
-
Production or batch number
-
Result of monitoring and, where applicable, inspections, and comparison with
requirements

Signature of the person in charge of in-house production monitoring
(4) All records must be preserved for at least five years and in the case of the moulding
compound, submitted to the external monitoring agency. They must be submitted to the DIBt
and to the most senior competent building monitoring agency if requested.
(5) In the event that test results are unsatisfactory, the manufacturer shall take the
necessary remedial action immediately. Containment units that do not meet the
requirements must be handled in such a way that they cannot be confused with compliant
products. After the defect has been corrected, the inspection in question must be
immediately repeated to the extent technically possible and necessary in order to prove that
it has been corrected.
2.4.3
Initial testing by an approved inspection agency
The tests in Annex 4, Section 2 must be carried out as part of the initial inspection.
2.4.4
Third-party monitoring of the moulding compound
(1) The in-house production monitoring at each manufacturing plant must be verified by an
external body in accordance with Annex 4, Section 1.1 on a regular basis, but at least once
per year.

(2) As part of third-party monitoring there must be an initial inspection of the PE moulding
compounds, and samples must be taken and tested in accordance with the last column of
the stipulated inspection plan in Annex 4, Section 1.1. Sampling and inspections are the
responsibility of the recognised monitoring agency.
(3) The results of certification and third-party monitoring shall be kept for a minimum period
of five years. They must be submitted by the certification/monitoring agency to the DIBt and
to the most senior competent building control authority, if requested.

Design and analysis provisions
(1) The containment units covered by this national technical approval are fire-resistant for
less than 30 minutes before becoming unsealed. Therefore when designing and measuring
installation facilities, appropriate measures should be taken to prevent fire spreading from
neighbouring areas as well as fire breakouts within the facility. Measures should be drawn
up in consultation with the building control authority and fire services.
(2) For further conditions pertaining to containment unit installation, refer to water and
occupational safety regulations, and the building code.
(3) Rainwater must not get into the containment units.
(4) The containment units must be protected against impact by vehicles, e.g. by installation
in a protected place, use of collision guards or installation in a special area.

Implementation provisions
(1) When incorporating, installing and re-positioning containment units used together to
create larger areas, the operator of a storage system is obliged to commission a specialist
firm, within the meaning of § 3 of the Ordinance on Facilities Dealing with Substances
Hazardous to Water of 31 March 2010 (Federal Law Gazette. I p. 377). This does not apply
if this type of work has been excepted from the specialist requirement by state regulations,
or the manufacturer of the containment unit uses its own specialist staff to carry out this
work.
(2) Where containment units are put together as surface systems, only the connecting
components delivered with the unit by the manufacturer may be used (see Annex 1.10).
When putting together the individual parts of the connecting components, they must be
connected such that they are impervious to liquids.
(3) When installing or re-positioning individual standing containment units, the operator of a
storage facility is obliged to use only qualified technical personnel (they need not however
belong to a specialist company).
(4) The containment units must be installed on a level, rigid surface or a carefully
compacted, fixed support surface (e.g. a continuous 5 cm thick cement screed or asphalt
layer).
