2. Restrictions on use
In no event will ACE Instruments be liable for any additional damage, incidental or consequential
damages such as, but not limited to, lost profits and loss of use arising out of the sale, manufacture
or use of the products sold under this disclaimer, regardless of whether such claims result from
contracts, negligence or other culpable acts. Careful testing of all products upon receipt for damage
and the intended use, repair and maintenance as described in the product literature supplied by ACE
Instruments is mandatory for this warranty. Repairs or maintenance by unqualified personnel will
void the warranty, as well as the use of unauthorized consumables or spare parts. As with all
technically demanding products, it is essential that all users of these products are familiar with the
use, capabilities, and limitations of the product as described in the product literature.
3. Advice restriction
The buyer confirms that he has examined the intended use and suitability of the purchased goods for
any purpose of use at his own responsibility. It is expressly agreed between the parties that any
technical or other advice from ACE Instruments regarding the use of the goods or services was
provided free of charge and at the sole risk of the purchaser. Therefore, ACE Instruments assumes no
responsibility or liability whatsoever from the recommendations or their results.
