Warranty, limitation of liability
Flexcell (VHF Technologies SA, Av. des Sports 26, 1400 Yverdon-les-Bains, Switzerland) makes no warranties express or implied, including, but not limited to
any condition, warranty or term as to satisfactory quality or fitness for purpose except the following : Flexcell grants the original Purchaser of this Product
a limited three (3) year warranty on the electrical performance of the module and a two (2) year warranty on defects of material and workmanship: we
guarantee that this unit will produce a minimum of 70% of its rated electrical performance for a period of three (3) years from the purchase date, and
that this Product is free of defects in materials and workmanship for a period of two (2) years from the purchase date. Upon purchase or receipt. Purchaser
shall inspect and/or test the quality of the delivered Product as soon as it is customary in accordance with usual business practice. Purchaser shall notify
Flexcell or the relevant retailer immediately from the date an alleged failure to conform with the specification(s) is discovered. If Purchaser fails to examine
the quality of the Product or to give notice according to this provision, the Product is deemed to have been accepted and any claim of breach of
warranty with respect to such Product shall be waived. Operating instructions are communicated to the Purchaser together with any purchased Product.
This warranty does not cover any Product which has been damaged by acts of God, misuse, neglect or improper installation or application, or
negligence in use, storage, transportation or handling, or following repair by anyone other than Flexcell or Flexcell's authorized representative. The
maximum liability of Flexcell under this warranty shall in any case not exceed the purchase price of the Product. Flexcell shall in any event not be respon-
sible for any damage to persons or to property, or for any loss of profit, expense, or other incidental, consequential or special damages arising out of the
use of, or inability to use, the Product. Products returned under this warranty to Flexcell or an authorized Flexcell distributor, will be either repaired or
replaced free of charge, or refunded at purchase price, at the option of Flexcell. This warranty does not cover any transportation costs for return of
module or for reshipment of any repaired or replaced module, or costs associated with installation, removal, reinstallation or adaptation, modification of
the original Product. This warranty is only applicable if the returned Product is accompanied by the original invoice (purchase date and name of retailer
must be indicated). Flexcell will accept no return without prior authorization. Any other form of warranty given by the retailer is entirely his own responsibil-
ity and no person is authorised to change the terms of this warranty of the manufacturer. This warranty does not affect the Purchaser's statutory rights
under governing national laws as to consumers' rights. In case of any translation of this warranty, the English version shall be attached and shall prevail in
the event of any inconsistency.

Flexcell (VHF Technologies SA, Av. des Sports 26, 1400 Yverdon-les-Bains, Suisse) ne donne aucune garantie expresse ou tacite, y compris (mais non
seulement) une quelconque condition, garantie ou un terme quant à la qualité satisfaisante ou l'adéquation à l'usage du Produit, à l'exception de la
garantie suivante : Flexcell accorde à l'Acheteur original de ce Produit une garantie limitée de trois (3) ans sur la performance électrique du module et
une garantie de deux (2) ans sur les défauts de matériau et de fabrication : nous garantissons que cet appareil produira un minimum de 70% de sa perfor-
mance électrique nominale pendant une période de trois (3) ans à partir de la date d'achat, et que ce Produit est exempt de défauts de matériaux et
de fabrication pendant une période de deux (2) ans à partir de la date d'achat.
Au moment de l'achat ou de la réception, l'Acheteur doit contrôler et/ou tester la qualité du Produit remis dès que cela est d'usage selon les pratiques
commerciales habituelles. L'Acheteur doit aviser Flexcell ou le détaillant concerné immédiatement si un prétendu manquement de conformité aux
caractéristiques techniques du Produit est découvert. Si l'Acheteur ne vérifie pas la qualité du Produit ou n'envoie pas d'avis conformément à cette
disposition, le Produit est considéré comme ayant été accepté et il est réputé avoir été renoncé à toute réclamation pour rupture de garantie concer-
nant ce Produit. Des consignes d'utilisation sont communiquées à l'Acheteur avec tout Produit acheté . Cette garantie ne couvre pas un Produit qui a
été endommagé par une catastrophe naturelle, un mauvais emploi, un mauvais entretien ou une installation ou application inadaptée, ou par impru-
dence lors de l'utilisation, du stockage, du transport ou de la manipulation, ou à la suite d'une réparation par quelqu'un d'autre que Flexcell ou un
représentant agréé par Flexcell. La responsabilité maximale de Flexcell selon cette garantie ne peut en aucun cas dépasser le prix d'achat du Produit.
Flexcell ne sera en aucun cas responsable pour des dommages aux personnes ou aux biens, ou pour tout manque à gagner, frais ou autre préjudice
indirect, incident ou spécifique résultant de l'utilisation, ou de l'incapacité d'utiliser le Produit. Les Produits retournés en application de cette garantie à
Flexcell ou à un distributeur agréé de Flexcell, seront soit réparés soit remplacés gratuitement , ou remboursés au prix d'achat, au choix de Flexcell.
Cette garantie ne couvre pas les frais de transport pour le retour du module ni pour la réexpédition d'un module réparé ou remplacé, ni les frais liés à
l'installation, à l'enlèvement, à la réinstallation, à l'adaptation ou à la modification du Produit original. Cette garantie n'est applicable que si le Produit
retourné est accompagné de la facture originale ( la date d'achat et le nom du détaillant doivent être indiqués). Flexcell n'acceptera aucun retour sans
autorisation préalable. Tout autre forme de garantie donnée par le détaillant est entièrement de sa responsabilité propre et personne n'est autorisé à
changer les termes de la présente garantie du fabricant. Cette garantie ne modifie pas les droits impératifs de l'Acheteur selon les lois nationales locales
en vigueur relatives aux droits des consommateurs. En cas de traduction de cette garantie, la version anglaise y sera jointe et prévaudra en cas de
contradiction entre les versions.
Gewährleistung, Haftungseinschränkung
Flexcell (VHF Technologies SA, Av. des Sports 26, 1400 Yverdon-les-Bains, Schweiz) übernimmt keine ausdrückliche oder stillschweigende Gewährleistung
einschließlich unter anderem in Bezug auf irgendeine Bedingung oder Zusicherung der ausreichenden Qualität und Gebrauchstauglichkeit mit
Ausnahme der folgenden: Flexcell gewährt dem Erstkäufer dieses Produktes eine beschränkte Gewährleistung von drei (3) Jahren auf die elektrische
Leistung des Moduls und eine Gewährleistung von zwei (2) Jahren für Material- und Verarbeitungsfehler: Wir garantieren für eine Dauer von drei (3) Jahren
ab dem Kaufdatum, dass diese Einheit mindestens 70 % ihrer elektrischen Nennleistung produzieren wird, und für eine Dauer von zwei (2) Jahren ab dem
Kaufdatum, dass dieses Produkt frei von Material- und Verarbeitungsfehlern ist. Nach dem Kauf oder Erhalt muss der Käufer die Qualität des gelieferten
Produktes so bald, wie es entsprechend der gewöhnlichen Geschäftspraxis üblich ist, untersuchen und/oder prüfen. Der Käufer muss Flexcell oder den
zuständigen Einzelhändler sofort informieren, sobald eine vermutliche Nichteinhaltung der Spezifikation(en) entdeckt wird. Wenn der Käufer es versäumt,
die Qualität des Produkts zu prüfen oder Flexcell oder den Einzelhändler gemäß dieser Bestimmung zu informieren, gilt das Produkt als angenommen und
es wird auf jeden Anspruch aus Nichteinhaltung einer Zusicherung verzichtet. Betriebsanweisungen werden dem Käufer zusammen mit dem gekauften
Produkt mitgeteilt. Diese Gewährleistung gilt für kein Produkt, das durch höhere Gewalt, falsche Benutzung, nachlässige oder unsachgemäße Installation
oder Anwendung oder Nachlässigkeit bei Benutzung, Lagerung, Transport oder Umgang oder nach einer Reparatur durch andere Personen als Flexcell
oder autorisierte Vertreter von Flexcell beschädigt wurde. Die Höchsthaftung von Flexcell gemäß dieser Gewährleistung geht in keinem Fall über den
Kaufpreis des Produktes hinaus. Flexcell ist auf keinen Fall für Personen- oder Sachschaden oder für Gewinnausfall, Unkosten oder andere beiläufig
entstandenen oder Folge- oder besonderen Schäden haftbar, die durch die Verwendung oder Unfähigkeit der Verwendung des Produktes entstehen.
Produkte, die gemäß dieser Gewährleistung an Flexcell oder einen autorisierten Flexcell-Händler zurückgegeben werden, werden nach Flexcells Wahl
entweder kostenlos repariert oder ersetzt oder ihr Kaufpreis wird zurückerstattet. Diese Gewährleistung schließt keine Transportkosten für die Einsendung
des Moduls oder für die Rücksendung von reparierten oder ersetzen Modulen oder Kosten in Verbindung mit der Installation, dem Ausbau, der Neuinstal-
lation oder Anpassung und Modifikation des Originalprodukts ein. Diese Gewährleistung gilt nur, wenn das Produkt zusammen mit der Originalrechnung
(Kaufdatum und Name des Einzelhändlers müssen angegeben sein) eingeschickt wird. Flexcell nimmt ohne vorherige Zustimmung keine Rücksendung an.
Jede andere Form der Gewährleistung, die vom Einzelhändler gegeben wird, erfolgt ausschließlich auf dessen eigene Verantwortung und keine Person
ist berechtigt, die Bestimmungen dieser Gewährleistung des Herstellers zu verändern. Diese Gewährleistung berührt nicht die gesetzlichen Rechte des
Käufers gemäß den nationalen Gesetzen zu den Verbraucherrechten. Bei einer Übersetzung dieser Gewährleistung muss die englische Version beigefügt
werden und sie ist im Fall von Widersprüchen ausschlaggebend.
